TERMS AND CONDITIONS

These Terms and Conditions (“Terms”) govern your use of the Klotho mobile application and related services (the “App” or “Klotho”). By downloading, accessing, or using Klotho, you agree to these Terms. If you do not agree, do not use the App.

1. Eligibility and Accounts

You must be at least 13 years old (or the minimum age of digital consent in your region) to use Klotho. You are responsible for the accuracy of the information you provide, for maintaining the confidentiality of your account credentials, and for all activity under your account. Notify us promptly of any unauthorized use of your account.

2. The Service

Klotho is a personal wardrobe and AI styling app that lets you build a digital wardrobe from photos, receive AI-generated outfit recommendations, generate and style an avatar, plan outfits, and save looks. We may add, change, or remove features at any time.

3. Subscriptions, Billing, and Cancellation

Klotho offers an optional auto-renewing subscription, Klotho Premium, which unlocks features such as unlimited wardrobe items, AI styling, avatar generation and try-on, and saved looks. The following terms apply to subscriptions:

•       Klotho Premium is offered on a monthly or annual basis. Current pricing is shown in the App at the time of purchase.

•       Payment is charged to your Apple ID account upon confirmation of purchase.

•       Your subscription automatically renews at the end of each billing period unless you cancel at least 24 hours before the end of the current period. Your Apple ID account is charged for renewal within 24 hours prior to the end of the current period.

•       You can manage or cancel your subscription at any time in your device's Account Settings (Settings → your Apple ID → Subscriptions). Deleting the App does not cancel your subscription.

•       If a free trial is offered, any unused portion of a free trial period is forfeited when you purchase a subscription, where applicable.

•       Prices may change. We will provide notice of price changes as required, and changes will not apply to the current paid period.

Refunds for purchases made through the App Store are handled by Apple in accordance with Apple's policies. We do not separately process App Store refunds.

4. AI-Generated Content

Klotho uses artificial intelligence to generate avatars, styling suggestions, and related output from the photos and inputs you provide. AI-generated content is produced automatically and may be inaccurate, imperfect, or not to your expectations. It is provided for personal, informational, and styling purposes only. You are responsible for how you use AI-generated output.

5. Your Content and Photos

You retain ownership of the photos and content you upload. By uploading content, you grant Klotho a limited license to process, store, and display that content solely to provide the App's features to you, including sharing it with our service providers (such as our AI and storage providers) as described in our Privacy Policy. You represent that you have the right to upload any photo you submit and that you will not upload photos of other people without their permission, or any content that is unlawful, infringing, or offensive.

6. Acceptable Use

You agree not to:

•       Use the App for any unlawful purpose or in violation of these Terms

•       Upload content you do not have the right to use, or that infringes others' rights

•       Attempt to reverse engineer, disrupt, or gain unauthorized access to the App or its systems

•       Misuse the AI features to generate harmful, deceptive, or unlawful content

•       Resell, redistribute, or commercially exploit the App without our permission

7. Intellectual Property

The App, including its design, branding, and software, is owned by Klotho and protected by intellectual property laws. These Terms do not grant you any ownership of the App. The “Klotho” name and logo may not be used without our permission.

8. Third-Party Services

Klotho relies on third-party providers (including Supabase for storage and authentication, fal.ai and Anthropic for AI processing, and Apple and RevenueCat for purchases) to operate. Your use of the App is also subject to those providers' terms where applicable. We are not responsible for third-party services we do not control.

9. Disclaimers

The App is provided “as is” and “as available” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or that AI output will be accurate or suitable for any particular purpose.

10. Limitation of Liability

To the maximum extent permitted by law, Klotho and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of or inability to use the App. Our total liability for any claim relating to the App will not exceed the amount you paid us, if any, in the twelve months before the claim.

11. Termination

You may stop using the App and delete your account at any time. We may suspend or terminate your access if you violate these Terms or misuse the App. Upon termination, your right to use the App ends, and we may delete your account information as described in our Privacy Policy.

12. Changes to These Terms

We may update these Terms from time to time. We will update the “Last updated” date above and, for material changes, provide notice in the App. Continued use of the App after changes take effect means you accept the updated Terms.

13. Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws principles. Any disputes will be subject to the exclusive jurisdiction of the state and federal courts located in California, to the extent permitted by applicable law.

14. Apple App Store Terms

These Terms are between you and Klotho, not Apple. Apple is not responsible for the App or its content. Apple has no obligation to provide support or maintenance for the App. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
